







Attention is described as a “scarce commodity” that is traded in “a marketplace.” This, it is further claimed, contributes to a “widespread sense of attentional crisis.” But is there really an attention market, and if so, what, if anything, is wrong with it? We defend the claim that there are markets in attention. We provide an account of such attention markets and use that account to address what is morally wrong with them. Our account draws on knowledge of how attention works and what roles it plays in the mind. The attention market trades in an ability to influence our attention – somewhat (though not exactly) like the labor market trades in an ability to influence how we use our capacity for work. Specifically, the commodity it trades in is attentional landscaping potential, viz. the ability to systematically influence patterns of attention by changes to the sensory environment individuals are exposed to. Attention markets thus, we argue, commodify influence over a human capacity that plays a central role in shaping individual experience, agency, and belief formation. This feature of attention markets makes them ethically problematic. As markets in access to external influence, attention markets pose a special threat to individual autonomy and escape the classical liberal defense of free markets. Those who value autonomy should worry about the attention markets that exist today.
An attention economic perspective on the future of the information age
In this paper, we apply an attention economic perspective to explain current and predict future trends in our society. We first describe the rise of the attention economy, and we highlight one important mechanism of this economy: a spiral of attention scarcity. Second, we show that an attention economic perspective provides glimpses of a potential future. In particular, we predict an information environment that increasingly targets citizens with attention-grabbing content, form, and technology; a continuing trend toward excessive media consumption levels; and a continuing trend toward inattentive uses of information. We also predict increasing problems of public misinformation and misconceptions; an increased prevalence of certain mental and physical health issues; and an increased reliance on technology to perform mental tasks. At the end of this paper, we show why and how despite these predictions, alternative futures are conceivable. These alternatives largely depend on the behavior of various social actors. We discuss resistance to the attention economy by consumers and producers, a laissez-faire policy toward the attention economy, a policy of taxing attention-seeking efforts, and the promotion of public values in regulatory policies toward the internet.

The marketplace of rationalizations
Recent work in economics has rediscovered the importance of belief-based utility for understanding human behaviour. Belief ‘choice’ is subject to an important constraint, however: people can only bring themselves to believe things for which they can find rationalizations. When preferences for similar beliefs are widespread, this constraint generates rationalization markets, social structures in which agents compete to produce rationalizations in exchange for money and social rewards. I explore the nature of such markets, I draw on political media to illustrate their characteristics and behaviour, and I highlight their implications for understanding motivated cognition and misinformation.

Epistemic Alienation and the Division of Labor
The division of cognitive labor leads to what Barry has recently called epistemic alienation: a problematic separation of individuals from epistemic goods. According to Barry, individuals are alienated from epistemic virtues because an efficient division of cognitive labor requires them to manifest a lack of virtues. I argue that this is a mistaken diagnosis of the source of epistemic alienation. Participating in high-functioning collectives does not prevent individuals from being robustly virtuous; rather, our cognitive limitations make it impossible for us to live up to the highest standards of epistemic conduct. Collectives transcend these cognitive limitations to achieve what individuals cannot by harnessing those same limitations in their members. Furthermore, I argue that we should distinguish the epistemic weaknesses that facilitate the division of cognitive labor from those that result from the division of labor. Only the latter are aspects of epistemic alienation. By dividing our cognitive labor over larger populations of agents and artifacts, we have massively accelerated our rate of epistemic productivity but have thereby created conditions that are variously inhospitable for the thinking of individuals by alienating them from the products, processes, and environments of inquiry. These forms of separation are problematic insofar as they amplify intellectual vices, incapacitate reason, and induce cognitive biases.

Restoring Consumer Sovereignty
For decades, there has been broad consensus within antitrust, intellectual property, and consumer law scholarship that consumers make decisions in their own best interests by consciously weighting the market’s relative prices, quantities, and qualities against each other. That consensus is unraveling in light of novel findings from cognitive and social psychology that explain how individuals’ concepts of what they prefer drive the global economy. At the same time, producers nowadays no longer merely satisfy consumers’ needs but also communicate their values, identities, and aspirations through the sale and marketing of products. As part of the growing interest in observations such as these, a wealth of psychological studies challenge the fundamental teaching of economics that the interplay of demand and supply of goods in a free market economy provides us with material wealth. This book provides a normative defense of that assumption and a theoretical framework for understanding its contradictions. It argues that the erosion of consumer sovereignty through the ability of product manufacturers and sellers to systematically take advantage of individuals’ psychological weaknesses demands a twenty-first-century reconceptualization of the consumer and a modern account of how the law should regulate the digital economy. Such an account is justified to ensure a diverse marketplace in which consumers can influence how our societies are structured and arranged. By examining the role that market manipulation plays, it offers ingredients for a realistic descriptive and normative market regulatory theory that is aware of its political economy, its behavioral suppositions, and its distributional consequences.

Thinking through other minds: A variational approach to cognition and culture
The processes underwriting the acquisition of culture remain unclear. How are shared habits, norms, and expectations learned and maintained with precision and reliability across large-scale sociocultural ensembles? Is there a unifying account of the mechanisms involved in the acquisition of culture? Notions such as “shared expectations,” the “selective patterning of attention and behaviour,” “cultural evolution,” “cultural inheritance,” and “implicit learning” are the main candidates to underpin a unifying account of cognition and the acquisition of culture; however, their interactions require greater specification and clarification. In this article, we integrate these candidates using the variational (free-energy) approach to human cognition and culture in theoretical neuroscience. We describe the construction by humans of social niches that afford epistemic resources called cultural affordances. We argue that human agents learn the shared habits, norms, and expectations of their culture through immersive participation in patterned cultural practices that selectively pattern attention and behaviour. We call this process “thinking through other minds” (TTOM) – in effect, the process of inferring other agents’ expectations about the world and how to behave in social context. We argue that for humans, information from and about other people's expectations constitutes the primary domain of statistical regularities that humans leverage to predict and organize behaviour. The integrative model we offer has implications that can advance theories of cognition, enculturation, adaptation, and psychopathology. Crucially, this formal (variational) treatment seeks to resolve key debates in current cognitive science, such as the distinction between internalist and externalist accounts of theory of mind abilities and the more fundamental distinction between dynamical and representational accounts of enactivism.

Rational Inattention: A Review
We review the recent literature on rational inattention, identify the main theoretical mechanisms, and explain how it helps us understand a variety of phenomena across fields of economics. The theory of rational inattention assumes that agents cannot process all available information, but they can choose which exact pieces of information to attend to. Several important results in economics have been built around imperfect information. Nowadays, many more forms of information than ever before are available due to new technologies, and yet we are able to digest little of it. Which form of imperfect information we possess and act upon is thus largely determined by which information we choose to pay attention to. These choices are driven by current economic conditions and imply behavior that features numerous empirically supported departures from standard models. Combining these insights about human limitations with the optimizing approach of neoclassical economics yields a new, generally applicable model.

The Right to Concentrate
In this paper, we clarify the nature and the scope of the right to concentrate. We argue that a right to concentrate constitutes a right against significant, non-consensual interference with a person’s concentration-requiring task. An agent has a right to concentrate when others have a duty not to intentionally or negligently distract her from her performance of a task that requires concentration when concentrating on the task is in the fundamental interests of the agent in question. We analyse the protection of the right to concentrate through different roles in concentration spaces, environments in which concentration-requiring tasks are protected through the governance of impermissible distractions and through norms regulating the access to and the use of such environments. This analysis helps us understand the relevant rights and duties in situations where an agent’s concentration on a task is in her fundamental interests.
